IR35 in the NHS: at a glance

  • IR35 became a priority of HMRC in 1999
  • Until April 2017, the financial and reputational risk sat with the contractor
  • Since April, the IR35 risk now sits with the hirer
  • Financial penalties greater than the sum of the unpaid tax may apply
  • IR35 status should be made by the Public Sector Body (NHS)
  • The NHS must take “reasonable care” when determining the status
  • Even if the contractor is engaged by an agency, it is the responsibility of the NHS to inform the agency of the IR35 status
  • Whoever pays the contractor must deduct relevant taxes
